On October 14, 2022, at 10 o’clock, a meeting was held between students of the educational programs 6B04202-Jurisprudence, 6B04203-Legal regulation of transportation, movement and operation of transport with the judge of the Specialized Investigative Court of the city of Uralsk, West Kazakhstan region Ismailova Raushan Toktasynovna.

During the conversation, the judge explained the judicial system of the Republic of Kazakhstan, and he also explained that the judicial system, starting from the second half of 2007, switched to electronic record keeping. A Single Automated Information and Analytical System (EAIAS) operates in all courts.

The Specialized Investigative Court of the city of Uralsk was established by order in 2018. The Criminal Procedure Code of the Republic of Kazakhstan has introduced a new procedural institute of an investigating judge, which testifies to Kazakhstan’s commitment to generally accepted international standards in ensuring fuller implementation of the principle of equality and competitiveness of the parties, increasing the effectiveness of the protection of citizens’ rights and freedoms.

The institution of investigating judges consists in the fact that the investigating judge exercises control over the legality of the proceedings, since at the same time he acts as an arbitrator for the participants in the criminal process, providing the ground for adversarial and legal equality of opportunities of the parties, and hence the fairness of justice. According to the norms of Article 55 of the CPC, an investigating judge is a judge of the court of first instance, whose powers include exercising judicial control over the observance of the rights, freedoms and legitimate interests of persons in criminal proceedings in accordance with the procedure provided for by this Code. The activity of investigative judges has shown the vitality of the institution of judicial control at the pre-trial stage of the criminal process.
