Information on the mandatory training of graduates of ZKITU studying under the state educational order

Upon completion of their studies at ZKITU, students (bachelor’s degree, master’s degree) under the state educational order are assigned a mandatory three-year training in organizations, regardless of the form of ownership, according to paragraph 17 of Article 47 of the Law of the Republic of Kazakhstan “On Education” (with amendments and additions as of 08.01.2021), the Rules for sending young professionals to work and paragraph 30 of the Rules referral of a specialist to work, granting the right to self-employment, exemption from the obligation or termination of the obligation to work by citizens, students on the basis of the state educational order approved by the Decree of the Government of the Republic of Kazakhstan dated 30.03.2012 No. 390.

In accordance with the amendments and additions to the Law of the Republic of Kazakhstan “On Education” No. 410-VI dated 08.01.2021, according to which:

1. Citizens of the Republic of Kazakhstan, work out in proportion to the time of their actual training under the state educational order after graduation from the organization of higher and (or) postgraduate education within the period provided for by this paragraph, in the following cases:

A) transfer from tuition on a paid basis to training under a state educational order;

B) transfer from training under the state educational order to training on a paid basis;

C) deductions from the organization of higher and (or) postgraduate education, subject to subsequent restoration during the current or next academic year.

2. Reimbursement of expenses incurred at the expense of budgetary funds is provided in proportion to the period actually worked out according to the formula for determining the working period.

The requirements for mandatory training by graduates who studied under the state educational order have been changed

Article 47 of the Law of the Republic of Kazakhstan “On Education” dated July 27, 2007 No. 319-III, regulating the issues of working out by graduates who studied on the basis of a state educational order, has been amended to expand the employment opportunities of university graduates.

Citizens from among rural youth who entered within the rural quota for training in pedagogical, medical, veterinary and agricultural specialties are required to work, respectively, in educational organizations, healthcare organizations, in subdivisions of state bodies operating in the field of veterinary medicine, in veterinary organizations and organizations, regardless of the form of ownership of the agricultural profile located in rural areas, at least three years after the end of the organization of higher and (or) postgraduate education. Before the introduction of the changes, testing could be carried out only in state organizations.

Citizens of the Republic of Kazakhstan who have entered pedagogical and medical specialties on the basis of a state educational order are required to work in educational organizations and healthcare organizations for at least three years after graduating from the organization of higher and (or) postgraduate education or scientific organizations in the field of healthcare.

Citizens of the Republic of Kazakhstan who have studied in other specialties on the basis of a state educational order are required to work for at least three years in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

Citizens of the Republic of Kazakhstan who have enrolled in doctoral studies under the program of Doctors of Philosophy (PhD) on the basis of a state educational order are required to work in organizations of higher and (or) postgraduate education or scientific organizations for at least three years after completing their studies.

Citizens of the Republic of Kazakhstan work out in proportion to the time of their actual training under the state educational order after graduation from the organization of higher and (or) postgraduate education within the period provided for in paragraph 17 of Article 47 of the Law of the Republic of Kazakhstan “On Education”, in the following cases:

1) transfer from tuition on a paid basis to training under a state educational order;

2) transfer from training under the state educational order to training on a paid basis;

3) deductions from the organization of higher and (or) postgraduate education, subject to subsequent restoration during the current or next academic year.

The distribution of graduates and exemption from working out the categories of graduates listed in paragraph 17-2 of Article 47 of the Law of the Republic of Kazakhstan “On Education” is carried out by the University Commission for the personal distribution of young professionals.

The right to priority assignment to work in state educational organizations have:

1) persons whose spouse lives, works or serves in the locality that provided the vacancy;

2) persons whose one or both parents are disabled, as well as persons who are guardians and trustees permanently residing in the locality that provided the vacancy.

Exemption from the obligation to work out provided for in paragraph 17 of Article 47 of the Law of the Republic of Kazakhstan “On Education” is granted by the decision of the commission on the personal distribution of young professionals to the following categories of young professionals:

1) persons in the absence of vacancies in the locality at the place of residence, work or service of the spouse (spouse);

2) disabled persons of group I and II;

3) persons enrolled for further study in residency on the basis of a state educational order, master’s degree, doctoral degree;

4) pregnant women, persons who have, as well as independently raising, a child (children) under the age of three years.

Termination of the obligation to work out, provided for in paragraph 17 of Article 47, without reimbursement of expenses incurred at the expense of budgetary funds related to training, occurs:

1) in connection with the performance of work-out duties;

2) in connection with the death of a student (young specialist), confirmed by the relevant documents;

3) in case of disability of group I and II during the period of working out;

4) in connection with the exemption from the obligation to work out in the cases provided for in paragraph 17-2 of article 47.

For failure to fulfill the obligation to work out, provided for in paragraph 17 of Article 47, a young specialist is obliged to reimburse the expenses incurred at the expense of budgetary funds in connection with his training, except for the cases provided for in paragraph 17-2 of article 47, to the budget.

Reimbursement of expenses incurred at the expense of budgetary funds is carried out in proportion to the period actually worked.

Resolution of the Government of the Republic of Kazakhstan dated November 18, 2022 No. 926

On Amendments and Additions to the Decree of the Government of the Republic of Kazakhstan dated March 30, 2012 No. 390 “On approval of the Rules for Sending a Specialist to Work, Reimbursement of Expenses Incurred at the Expense of Budgetary Funds, Granting the Right to Self-employment, Exemption from the Obligation or Termination of the Obligation to Work by citizens who studied on the basis of a state educational order, and Amendments and Amendments to the Resolution of the Government of the Republic of Kazakhstan dated January 23, 2008 No. 58 “On approval of the Rules for awarding an educational grant”

Upon completion of training at ZKITU, students (bachelor’s degree, master’s degree) under a state educational order are required to work out in organizations, regardless of the form of ownership, according to the Rules for sending young specialists to work and paragraph 30 of the Rules for sending a specialist to work, granting the right to self-employment, exemption from the obligation or termination of the obligation to work out by citizens studying on the basis of the state educational order approved

Resolution of the Government of the Republic of Kazakhstan dated 30.03.2012 No. 390.

  1. The following amendments and additions were made by the Decree of the Government of the Republic of Kazakhstan dated November 18 , 2022 No. 926:
    Citizens of the Republic of Kazakhstan from among rural youth who entered within the quota established by subparagraph 3) paragraph 8 of Article 26 of the Law, for training in pedagogical, veterinary and agricultural specialties, are worked out, respectively, in educational organizations, subdivisions of state bodies operating in the field of veterinary medicine, veterinary organizations, agricultural organizations, regardless of the form of ownership, located in rural areas, for at least three years after graduation from the organization of higher and (or) postgraduate education (hereinafter – OVPO).
  2. Citizens of the Republic of Kazakhstan from among rural youth who entered within the quota established by subparagraph 6) of paragraph 8 of Article 26 of the Law for training in pedagogical, technical and agricultural specialties, work in the regions, the list of which is defined in Annex 1 to these Rules, for at least two years after the end of the OVPO.

Citizens of the Republic of Kazakhstan, specified in paragraphs 3, 4, 5, 6, 7 and 8 of these Rules, work out in proportion to the time of their actual training under the state educational order after the end of the OVPO within the period provided for by this paragraph, in the following cases:

1) transfer from tuition on a paid basis to training under a state educational order;

2) transfer from training under the state educational order to training on a paid basis;

3) deductions from the PSB, subject to subsequent restoration during the current or next academic year.

The working time is calculated according to the following formula:

T = y/х*z,

Т – the term of working out in months, without splitting into days (at the same time rounding is made in a big way);

y – is the actual period of study based on the state educational order in months, without splitting into days (while rounding is made up);

x – is the total period of study in OVPO in months (with rounding up);

z – the term of working out specified in paragraphs 3, 4, 5, 6, 7 and 8 of these Rules is for citizens of the Republic of Kazakhstan who have studied for the entire period on the basis of a state educational order, which is 36 months.

  1. The distribution and referral to work of citizens of the Republic of Kazakhstan specified in paragraph 17 of Article 47 of the Law, with the exception of doctors in the profile and doctors of philosophy (PhD), are carried out in the following order:

1) the distribution commissions annually, no later than January 15, send to the local executive bodies of the regions applications in hard copy and (or) in the form of an electronic document indicating the number of graduates (including surnames and initials), their places of permanent residence, the specialty and language of instruction for the provision of vacant jobs for subsequent employment of graduates of the current year who have entered:

– within the quota provided to citizens of the Republic of Kazakhstan from among rural youth;

– based on the state educational order.

2) local executive bodies of the regions, according to the submitted applications specified in subparagraph 1) of this paragraph, shall submit, no later than February 15, on paper and (or) in the form of an electronic document to the distribution commission, information on the need for personnel in the specialties declared by the distribution commissions:

– in educational organizations, subdivisions of state bodies carrying out activities in the field of veterinary medicine, veterinary organizations, agricultural organizations, regardless of the form of ownership, located in rural areas, for citizens of the Republic of Kazakhstan from among rural youth enrolled within the quota established by subparagraph 3) paragraph 8 of Article 26 of the Law, for training in pedagogical, veterinary and agricultural specialties;

  1. The personal distribution of citizens of the Republic of Kazakhstan, specified in paragraph 17 of Article 47 of the Law, who are completing their studies this year, is formalized by a protocol decision of the relevant distribution commission annually, no later than July 1, on the basis of which the OVPO prepares job referrals in accordance with Annex 2 to these Rules. At the same time, the notification of the citizens of the Republic of Kazakhstan, specified in paragraph 17 of Article 47 of the Law, about their distribution is carried out by the OVPO by issuing directions to work no later than three working days from the date of the protocol decision.

It is allowed to issue a protocol decision of the relevant distribution commission in the form of an electronic document certified by electronic digital signatures of the members of the distribution commission present at the meeting.

5 . Reimbursement of budget expenditures in case of non-processing is carried out in proportion to the actual period worked out according to the following formula:

S1 = (z – d) * S / z,

S1 – the amount to be refunded to the budget, in tenge;

d – the actual working period in months, without splitting into days (while rounding is made up);

z – is the period of working out specified in paragraphs 3, 4, 5, 6, 7 and 8 of these Rules for citizens of the Republic of Kazakhstan who have studied for the entire period on the basis of a state educational order, which is 36 months;

S – is the amount of budget funds spent for the entire period of study based on the state educational order.
